Which Law Regulates Abortion in Spain?

Main Changes to the Abortion Law (2023 Reform)
The latest reform introduced important changes to improve access:
Removal of the mandatory reflection period: It is no longer necessary to wait three days from receiving the information to the procedure.
Guaranteed access close to home: The aim is to ensure abortion care can be provided as close as possible to the woman’s home.
Abortion for minors (ages 16 and 17): Current regulations recognise their capacity to decide and give consent without needing authorisation from their legal representatives.
Specific medical leave: Specific leave is created for termination of pregnancy.
Legal Time Limits for Abortion
01 Up to Week 14 (Inclusive)
You can end your pregnancy freely, without needing to state any specific reason.
02 Between Week 14 and Week 22 (Inclusive)
Abortion is allowed for medical reasons: serious risk to the pregnant person’s life or health (physical or mental), or risk of serious fetal anomalies (requires a medical report).
03 From Week 22 Onwards
Only permitted in exceptional cases: fetal anomalies incompatible with life or severe, incurable fetal disease (requires confirmation by a clinical committee).
Important: Legal Time Limits vs. Medical Time Limits
Remember that the time limits set by law differ from those recommended for each method.
For example, although abortion is legal up to week 14, the medical method is only recommended up to the 9th week.
